Federal Law No. 219-FZ comes into effect. It’s aimed at improving the regulatory system in the field of environmental protection and introducing the best available technologies

    From January 1, 2019, the provisions of Federal Law No. 219-FZ of July 21, 2014 “On Amending the Federal Law ‘On Environmental Protection’ and Certain Legislative Acts of the Russian Federation” are into effect. They regard the state regulation of environmental impact of objects of different categories of hazard.
   In accordance with paragraph 1 of Article 31.1 of the Federal Law No. 7-FZ of January 10, 2002 “On Environmental Protection” (effective from January 1, 2019) legal entities and individual entrepreneurs operating at facilities of 1st category of hazard must receive comprehensive environmental permit that is a document available technologies containing environmental requirements and standards established by the authorized body to control legal entities and individual entrepreneurs. A comprehensive environmental permit is issued for a certain facility that has a negative impact on the environment, including a linear facility.
   According to Part 6 of Art. 11 of the Law No. 219-FZ, legal entities and individual entrepreneurs operating at facilities of the 1st category of hazard included in the specific List of Objects must apply for a comprehensive environmental permit in the period from January 1, 2019 till December 31, 2022. This List of Objects of the 1st category has been approved by order No. 154 of the Ministry of Natural Resources of Russia dated April 18, 2018 and includes 300 objects.
   Legal entities and individual entrepreneurs operating at facilities that correspond to application of the best available technologies and not included in the List are required to obtain a comprehensive environmental permit before January 1, 2025. Besides that, this document can be issued to the companies of 2nd category, if relevant Best available technologies reference documents are available.
   A comprehensive environmental permit includes:
    - technological standards for discharges and emissions, calculated per unit of output;
    - standards for permissible discharges and emissions containing substances of 1st and 2nd hazard classes;
    - limits on waste disposal and requirements for their treatment;
    - approved and agreed program of industrial and environmental control;
    - information about the validity of the permission.
   Legal entities and individual entrepreneurs are obliged to fulfill the conditions of the comprehensive environmental permit, and take responsibility for their non-compliance or functioning without a comprehensive environmental permit.
